South Dakota Sees Uptick in Un-Belted Driver Deaths






The South Dakota Department of Public Safety says there has been a considerable bump in the number of drivers who die simply because they crash although not wearing a seat belt this year.


Public Safety Department Secretary Trevor Jones mentioned that 83 % of deaths from auto crashes as of April 9 involved an un-belted victim.


That’s up from about 60 percent in previous years.


So far this year there have been 18 deaths reported from auto crashes in South Dakota. Of these, 15 of the victims weren’t restrained.


Jones says neglecting to wear a seat belt indicates drivers are more likely to be thrown from a automobile throughout a crash.


The Highway Patrol is reminding motorists that state law requires drivers and front seat passengers to buckle up.

In a story that is breaking now, NASCAR has suspended Stewart-Haas racing driver Kurt Busch indefinitely, “for actions detrimental to stock car racing.”

This comes in the wake of a restraining order granted to Busch’s ex-girlfriend, Patty Driscoll, on Monday. The other shoe dropped this afternoon when Kent County, Delaware, court commissioner David Jones released a written opinion on the matter in which he stated:




“It is more probably than not that on Sept. 26, 2014, (Busch) committed an act of abuse against (Driscoll) by manually strangling (Driscoll) with his left hand on her throat whilst placing his proper hand against her chin and face, causing her head to forcefully strike the interior wall of (Busch’s) motor property, thereby recklessly causing physical injury to (Driscoll).”




The September incident allegedly took place in Busch’s motorhome at Dover International Speedway.



At this time, there’s no statement from Busch or Stewart-Haas Racing, although the team is stated to have a contingency program in location for Sunday’s Daytona 500.




In the court proceedings top up to Driscoll being granted the order of protection, Busch famously made news when he claimed, below oath, that Driscoll was a trained assassin.

Earlier this week we found a massive wake-up call to fleet operators at the announcement by the RTMC of the large numbers of truck drivers and public transport drivers who are not validly licensed.


In the story titled “Close to half a million freight and public drivers do not qualify to be on South African roads says RTMC” we found some rather alarming statistics on the numbers of illegal drivers on our roads!


Wheels24 also commented on this in a story titled “500 000 ‘pro drivers’; loose without docs”


The Arrive Alive website was asked for comment on we replied with the following:


“What we know would be true is that there is a breach of contract in such an instance between the insurer and the insured client. The insurance contract would be based on the agreement that a roadworthy vehicle will be transported at all times by a legally licensed driver . If these conditions are not complied with the insurer will in my mind have a right to repudiate such a claim should it arise..”


We have since confirmed this with several insurers and would like to share a comment received from the truck insurance experts from Hollard:


“The insurance policy clearly excludes cover for a client where a client is not validly licensed and this would extend as far as the PRDP for trucks and taxi drivers. The Insurer does not even have to prove this was the cause of the claim as the Ombudsman will not assist anyone breaking the law.


On the issue of a roadworthy vehicle most policies actually state the lack of road worthiness must have been material to the claim. For example if a driver’;s tyres are smooth and the vehicles skids after breaking, the claim will not be paid.”


It is also worth noting what Justice Project South Africa has to say on this matter. Howard Dembovsky emphasizes the need for greater enforcement on this matter:


“I completely concur with your assertions on this. Not only may an insurance company repudiate any claim, but I can say with almost absolute certainty that they would. Insurance companies are in the business of minimising their risks and pay-outs and the lack of a PrDP when operating a vehicle of the class that requires one essentially means that the driver is unlicensed to operate the vehicle. What absolutely gobsmacks me though is the fact that the RTMC has made these assertions yet we rarely hear of any law enforcement exercises where HGV drivers are taken to task over this issue.”


Every driver who drives without the required driver license is breaking the law. If negligence has to be established in the event of a road crash, driving without a valid license would be a first step to confirm that the conduct of the driver deviated from that of a reasonable driver. [ The Pinetown truck crash is an example where the license was found to be fraudulent]


It is important to emphasize that your insurance will only cover damages of the driver and vehicle is legally licensed – you will not be able to challenge the insurer who repudiates such an insurance claim  - a risk no transport operator can afford to take!

Texas Concerns Information Contact on Named Driver Policies, Excluded Driver Endorsements






The Texas Department of Insurance coverage has issued a particular information contact to receive info from insurance coverage companies writing private passenger automobile insurance in Texas.


TDI mentioned the information requested is in response to legislative inquiries and pertains to bodily injury and property damage liability claims below named driver policies or policies with an excluded driver endorsement.


Insurers must respond to this data contact no later than March 3, 2015, TDI stated.


At least 2 bills — HB 318 by Rep. Mark Keogh and HB 335 by Rep. Ed Thompson — have been introduced in Texas that would prohibit automobile insurers from issuing named driver policies in the state. HB 335 would enable a named driver exclusion beneath certain circumstances.


For the purposes of the data get in touch with, TDI is making use of the following definitions:


  • Named Driver Policy – An automobile insurance coverage policy that does not provide coverage for an person residing in a named insured’s household specifically unless the individual is named on the policy. The term contains an automobile insurance policy that has been endorsed to supply coverage only for drivers specifically named on the policy.

  • Excluded Driver Endorsement – An endorsement attached to a private passenger automobile insurance policy that excludes coverage for a particular person particularly named in the endorsement.

  • Regular Policy – A private passenger automobile insurance coverage policy that supplies coverage for the named insured, named insured’s spouse, household members residing in the household, and other people using the insured automobile.  A normal policy does not consist of a named driver endorsement or an excluded driver endorsement.

  • Other Policy Types – Any other type of private passenger automobile policy that is not a Named Driver Policy or a Normal Policy, and is not a policy with an excluded driver endorsement.

  • Claim – A claim that is reported per occurrence for liability combined, not per claimant or per coverage.

Reported policy varieties should equal 100 percent of the total book of private passenger automobile enterprise.

Answer:


An IDP is not a PRDP but just an international translation of a licence. Zimbabwe has a document referred to as a defence driving certificate that serves a similar purpose to a PRDP. It does however not serve as a dangerous goods permit as additional training is required for that.

I would like to know if one has a learner drivers license, can he be assisted by a person with a drivers license less that a year? In other words, how long do you have to have your license before you can assist a person with a learner drivers license?
Answer:


The current regulations do not specify how long the driver must have held a driving licence before being allowed to supervise a person holding a learner’;s licence. There is a requirement that the driving licence must be valid and for the same class of vehicle being driven by the learner driver. See the regulation below.

(2) (a) The holder of a learner’s licence shall, except where such licence relates to a motor vehicle having no seating accommodation for a passenger or to a motor cycle, when driving the vehicle concerned, be accompanied in or on that vehicle by, and be under the direct personal supervision of a person seated next to him or her, or immediately behind him or her, where such person cannot be seated next to him or her, and who is in possession of a licence, other than a learner’s or similar licence, authorising him or her to drive that class of motor vehicle.

My truck, abnormal vehicle, was driving on the N11 and was stopped by a traffic officer claiming visibility is poor. The driver in turn claimed he could see well ahead of him. Now how far must the driver be able to see, or is it about other vehicles seeing him from behind?

Answer:


I assume one of the conditions of the permit was that the vehicle must pull over in poor visibility.


The only provision is reg 157 that deals with the distance a person must be able to see before he must switch his head lamps on.


Vehicles to be equipped with certain lamps and times when certain lamps to be lighted


Reg 157.     (1)        No person shall operate on a public road a motor vehicle unless—


(a)        all lamps fitted to a motor vehicle as contemplated in regulations 159 to 184 inclusive, are undamaged, properly secured, and capable of being lighted at all times; and


(b)        the head lamps, rear lamps and number plate lamps are kept lighted during the period between sunset and sunrise and at any other time when, due to insufficient light or unfavourable weather conditions, persons and vehicles upon the public road are not clearly discernible at a distance of 150 metres: Provided that the provisions of this paragraph shall not apply to a motor vehicle parked off the roadway of a public road or in a parking place demarcated by appropriate road traffic signs or within a distance of 12 metres from a lighted street lamp illuminating the public road on which such vehicle is parked.


(2)        No person shall operate on a public road a motor cycle, a motor cycle with a side car, a motor tricycle or motor quadrucycle, unless the headlamp of such vehicle is lighted at all times: Provided that the provisions of this subregulation shall not apply to a motor cycle, motor cycle with side car, motor tricycle or motor quadrucycle manufactured before 31 December 1960 which is used only during the period from sunrise to sunset.

South Africa was rocked by the news report on Tuesday 14th October 2014 that a a shocking crash occurred on the N12 Alberton freeway. 4 innocent people were killed and 57 or thereabouts, were injured.


The next morning at 8am the Honourable Minister of Transport, Ms D. Peters, announced that a lack of driver training was responsible for the road carnage.


SAIDI has the solutions to the lack of adequate and fully comprehensive driver training.


SAIDI has extensive plans for every driving instructor in South Africa to be trained to the highest possible standard, comparable to International standards, to suit South African conditions, provided we can secure an appointment with the Honourable Minister of Transport, Ms Dipuo Peters.


We are all geared to “train the trainers” to prepare a massive contingent of driving instructors to offer excellent driving instruction with exactly the same fully-comprehensive training, across the board, to meet the need of all the whole driving population in the country.


We believe there can be no compromise when it comes to road safety. This is a matter of life and death, when we consider the devastation just one driver can cause.


So we believe the time is over to stop talking about road safety.


SAIDI has workable solutions!


Now it is time to accept our God-given responsibility and to train the Nation’s drivers, to reduce the official road fatality statistics (an official average statistic of 14 000 people a year, which might feasibly actually be as high as 22 000 according to a highly-experienced practising paramedic), and get down to teaching the public new ways of protect themselves from becoming victims of other drivers’ bad driving.


We either train drivers comprehensively, covering defensive and advanced training techniques, or we don’t do it at all.


Our plan includes:


  1. Refresher course for experienced drivers, with insurance benefits;

  2. Understanding what affects drivers attitudes:

  3. Upgrading the defensive driving standards of all licenced drivers;

  4. Thorough and comprehensive learner’s licence training directly from the national road traffic act;

  5. New driver training;

  6. “finishing off” lessons;

  7. Per-primary school children;

  8. Primary school pupils;

  9. High school pupils;

  10. Foreigners and immigrants;

  11. Habitual offenders;

  12. People with disabilities, such as paraplegics and quadriplegics;

  13. Pregnant mothers, mothers with babies and children;

  14. Senior drivers; people who have suffered traumatic brain injuries, etc. etc.

and it provides many totally unexpected additional benefits to the community as a whole.

The next morning at 8am the Honourable Minister of Transport, Ms D. Peters, announced that a lack of driver training was responsible for the road carnage.


SAIDI has the solutions to the lack of adequate and fully comprehensive driver training.


SAIDI has extensive plans for every driving instructor in South Africa to be trained to the highest possible standard, comparable to International standards, to suit South African conditions, provided we can secure an appointment with the Honourable Minister of Transport, Ms Dipuo Peters.


We are all geared to “train the trainers” to prepare a massive contingent of driving instructors to offer excellent driving instruction with exactly the same fully-comprehensive training, across the board, to meet the need of all the whole driving population in the country.


We believe there can be no compromise when it comes to road safety. This is a matter of life and death, when we consider the devastation just one driver can cause.


So we believe the time is over to stop talking about road safety.


SAIDI has workable solutions!


Now it is time to accept our God-given responsibility and to train the Nation’s drivers, to reduce the official road fatality statistics (an official average statistic of 14 000 people a year, which might feasibly actually be as high as 22 000 according to a highly-experienced practising paramedic), and get down to teaching the public new ways of protect themselves from becoming victims of other drivers’ bad driving.


We either train drivers comprehensively, covering defensive and advanced training techniques, or we don’t do it at all.


Our plan includes:

  3. Upgrading the defensive driving standards of all licenced drivers;

  4. Thorough and comprehensive learner’s licence training directly from the national road traffic act;

  6. “finishing off” lessons;

  7. Per-primary school children;

  8. Primary school pupils;

  9. High school pupils;

  10. Foreigners and immigrants;

  11. Habitual offenders;

  12. People with disabilities, such as paraplegics and quadriplegics;

  13. Pregnant mothers, mothers with babies and children;

  14. Senior drivers; people who have suffered traumatic brain injuries, etc. etc.

and it provides many totally unexpected additional benefits to the community as a whole.
