$5.9M Settlement Proposed in Acadian Ambulance Lawsuit

A hearing on a proposed settlement in the $ 5.9 million class action lawsuit against Lafayette-primarily based Acadian Ambulance company is scheduled for these days in Louisiana’s Avoyelles Parish.

The Advertiser reports 440 Louisiana residents have filed claims that they had been overcharged by Acadian Ambulance for solutions sometime in the final 2 decades.

The lawsuit accuses the company of billing and collecting greater fees than known as for in its agreement with insurance coverage carriers, attorney Larry Centola stated.

The lawsuit alleges that Acadian was supplying solutions to insured buyers at an insurance coverage-approved reduced rate for medical emergencies such as heart attacks. Even so, if a third celebration was at fault in a vehicle accident, for instance, Acadian would bill individual individuals in full, not via the insurance company, Centola stated.

“What Acadian was doing is that if a person was in a auto wreck, the company was not taking the health insurance coverage and instead billing the person for the third party liability automobile insurance for a larger amount,” Centola, who represents the plaintiffs, stated.

The class action lawsuit involves people who had been billed by or paid for services from Acadian among Jan. 1, 1994, and Dec. 31, 2013. The deadline to file a claim is July 24.

The original judgment called for Acadian to pay $ 17 million, which was reduced when Acadian effectively moved for a new trial.

On June 25, Allyson Pharr, Acadian Ambulance senior vice president of legal and governmental affairs, issued a statement to The Day-to-day Advertiser defending its billing practices.

“After much more than 10 years of defending itself, Acadian Ambulance has entered into a tentative settlement to finish 2 class action lawsuits pending against it involving claims of overpayments for solutions,” Pharr said through e mail. “This really challenging decision was produced out of consideration for our employees and the men and women in the communities in Louisiana we serve.

A fairness hearing is scheduled in Marksville to hear any individual who objects to the settlement.

According to the legal notice, reimbursement from the $ 5.9 million settlement is expected to be distributed in August or September.
