Chrysler Goes To Trial Over Fiery Jeep Crash, Defends Fuel Tanks

ca0bb Jeep fire Cassidy Jarmon Texas 626x465

A 2006 fatal crash involving a 1993 Jeep Grand Cherokee and one more 4-year-old youngster burned to death, Cassidy Jarmon, is pictured in Cleburne, Texas.

Older Jeeps with fuel tanks situated behind the rear axle might lead to explosive testimony in case against Chrysler beginning trial in Georgia. This month, a loved ones whose 4-year-old son burned to death in the back of a 1999 Grand Cherokee is beginning trial against the automaker—and in contrast to most large organizations facing wrongful-death claims, Chrysler is refusing to settle.

Bryan and Lindsay Walden of Bainbridge, Georgia, brought the suit against Chrysler in July 2012, 4 months following their son, Remington, was killed when a 1997 Dodge Dakota rear-ended the ’99 Grand Cherokee in which he was riding. According to Automotive News, the boy only suffered a broken leg from the influence but “died screaming in a fire so intense his chest fused to the Jeep’s door” as he attempted to escape his booster seat. He may possibly have been alive for an complete minute even though engulfed in flames.

As heart-wrenching as this account is, the Waldens aren’t alone. There are more than 70 fire-associated deaths from rear-end collisions in older Grand Cherokees and Libertys, according to the Detroit News. Security advocates like Jenelle Embrey—who claimed to witness a mother and teen burn to death in a Grand Cherokee and later sent an on the internet petition with 128,000 signatures to the National Highway Traffic Safety Administration in 2013—say there are hundreds far more.

Embrey’s petition led to a NHTSA investigation that discovered greater-than-average fatality rates amongst 1993-1998 Grand Cherokee and 2002-2007 Liberty models. Chrysler contends that these are higher-speed, high-energy collisions, that the Jeeps are no less protected than their contemporaries, and that they met all safety standards of the time.

In June 2013, soon after initially refusing a NHTSA recall request, Chrysler did recall 1.56 million of those Jeeps and sent letters to yet another 710,000 owners of later, 1999-2004 Grand Cherokees as a “customer service campaign,” advising them to bring in their vehicles to have tow hitches installed.

ca0bb Jeep Liberty tow hitch fuel tank fix 626x458

On these Jeeps, the fuel tanks are positioned behind the rear axle just inches away from the rear bumper and have fuel filler hoses that run by means of the frame rails. Beginning with the redesigned 2005 Grand Cherokee, Chrysler repositioned the tank away from the rear bumper.

2f8ab Jeep Grand Cherokee tow hitch fuel tank fix 626x438

The trailer hitch is supposed to provide some additional measure of protection for the fuel tank, at least in low-speed collisions. But former NHTSA administrator Joan Claybrook says these hitches may really do more damage, citing a Grand Cherokee fire in 2006 throughout which the hitch pierced the tank. Claybrook, as element of Nader’s Center for Auto Safety, suggested that NHTSA require Chrysler to set up metal shields and reinforce the filler hose, and crash-test a car with these upgraded parts.

The Walden case presents a lot more trouble for Chrysler. As an alternative of a closed settlement, a jury will make a decision Chrysler’s fate and could simply open the door to further, effective lawsuits. Details from the case are currently getting created public, such as the deposition of Fiat-Chrysler CEO Sergio Marchionne in January, who said that he does not think there is the “slightest proof that Grand Cherokee or the class that we’re talking about here are defective.”

That a tiny civil suit in Georgia is even involving the CEO of a giant, global automaker should be proof that these fuel tank fires have substance in court. It is not recognized whether or not Chrysler has settled any related cases.

Detained for being over the legal limit of alcohol? A few things Justice Project says you to be aware of!

Question:

Hi, I have a quick query. If you are detained for being over the legal limit of alcohol AND you are taken to be held in a holding cell, how long are you required to be there, is there a compulsory time period or are you able to be released one you have called a friend and they have come with the bail money, is there a need to be detained any further?

Also, if the police station has run out of “stationery” is it right for them to keep you detained for hours after even if you have the bail money? Surely that is prejudicial treatment to the one who is being detained because it is the stations’; mismanagement of their resources which has left the detained subject to suffer longer hours of detainment than is necessary.

And when giving blood, if you mention that you only allow YOUR medical practitioner to withdraw blood (before blood is drawn) and the ones drawing blood choose to not give you the option to call your medical practitioner, is that legal? I should think not.

;

Answer:

Your question/s may have been “quick” to ask, but they are certainly not quick to answer. I shall however do my best to keep my answers short.

;

  1. When a person is arrested for alleged driving under the influence of alcohol, SAPS Standard Operating Procedures (SOPs) dictate that such a person must be detained for a minimum period of 4 hours so they may sober up before being released. In reality however, this period is often in excess of twelve hours.

  2. A person who is detained for any criminal offence cannot simply be released until such time as the necessary documentation required to be contained in the docket has been completed and it is usually a detective that needs to complete such documentation.

  3. Whilst there are always detectives on duty, at night or over weekends, there are usually not as many detectives on duty as would be the case during “normal working hours”.

  4. I am not sure what you mean by the police station “running out of stationary” and therefore cannot comment on that beyond saying that if this were the case, one would think that your friend would have been detained until such time as he appeared before a court, or stationary was acquired.

  5. Persons who are detained after allegedly committing a crime must be brought before a court within 48 hours of their arrest, except where such a time would occur over weekends and public holidays. Where it does, they must be brought before a court on the next court day.

  6. The purpose of the above provision is for the arrested person to make an application for release on bail, however the Criminal Procedure Act further allows a policeman to grant bail to a detained person at any time before that. It does not however say how speedily they should do so, nor does it compel them to grant bail.

  7. Insofar as the drawing of a blood sample for evidentiary purposes goes, your friend, and everyone else for that matter, has no right to demand that their medical professional of choice draw their blood sample. Section 65(9) of the National Road Traffic Act also defines refusal to provide a breath and/or blood sample as a criminal offence and whilst I realise that your friend may not necessarily have entirely refused to provide a blood sample, that would not be helpful to his case.

  8. There is also a requirement in Section 65(3) of the National Road Traffic Act further requires that a blood sample be drawn within 2 hours of the alleged offence.

;

It is my view that lengthy detentions of any person accused of any non-violent crime are both, unnecessary and counter-productive and this practice should really be reviewed by SAPS management as a matter of urgency. Furthermore, whilst SAPS SOPs hold that intoxicated persons should be checked on regularly (once per hour), or more regularly (once every half an hour) if that person is severely intoxicated. In reality, this rarely happens as prescribed and even if it did, a person can drown in their own vomit in a matter of minutes if they are intoxicated to the extent that they are comatose.

;

Every case is different however and unfortunately, in this particular matter, it sounds to me like your friend’s behaviour towards police may have aggravated his position. Police men and women are human beings too and when people become uncooperative, and sometimes, combatant with them, it is very hard for them to resist the temptation to take longer to do something – thereby further inconveniencing the source of their frustrations, without breaking the law. The behaviour described in this story appears to indicate that your friend was obstructive towards police and this could most certainly have aggravated the situation and extended his detention, as opposed to helping the situation.

;

Best Regards,

;

Insurers slam government over price of car insurance coverage

The government is “putting young lives at risk and growing the cost of motor insurance” by failing to introduce reforms such as a graduated driving licence, the Association of British Insurers (ABI) stated this week.

588e6 fiesta crash

The insurance coverage company trade physique says insurers have kept their side of a bargain set at a government and insurance sector “summit” 3 years ago, but that the government has broken the promises it produced.

James Dalton at the ABI mentioned: “While great progress has been created, more can be accomplished to help bring down auto insurance premiums, especially for young drivers.”

So what’s really going on?

Driving reforms

A single of the issues discussed at the summit was the price of personal injury claims to the insurance coverage sector – and, because expenses are reflected in premiums, its customers.

Whiplash claims alone had been pushing up the cost of vehicle cover for everyone by about £90 a year, according to insurer Aviva. And to make matters worse, a hefty proportion of such personal injury claims are recognized to be fraudulent.

That is why the government has because implemented civil justice program reforms developed to strip out excessive legal charges and crack down on frivolous and exaggerated claims.

Consumer savings

According to the ABI, such measures have enabled insurers to pass on total savings of nearly £600 million to their buyers.

Premiums for young drivers, however, have remained high due to the fact “measures to boost young driver road security have stalled”.

Young and dangerous

Drivers amongst 17 and 19 years of age make up just 1.5% of all licence-holders. But new motorists in this age group are involved in 12% of fatal or critical accidents.

Even young drivers who stick to the guidelines and keep protected face sky high insurance premiums as a outcome.

To save lives and lessen premiums, the ABI is consequently calling for the introduction of a ‘graduated’ driving licencing regime. It believes this will reduce the quantity of crashes involving young motorists.

“The Government’s continued failure to make meaningful alterations to improve young driver testing and instruction is not only placing their lives at risk, but keeping the expenses of motor insurance coverage for young drivers unnecessarily high,” Dalton said.

Claim fees

Other regions where the ABI believes the government could do much more to decrease insurance charges for motorists consist of sending much more individual injury claims to the little claims courts.

“The little claims track, with the suitable safeguards place in place, is a cost-efficient, simple and speedy way of settling decrease worth individual injury claims,” mentioned Dalton, who would like to see the modest claims limit raised from £1,000 to £5,000.

Insurers also want much more to be completed to clamp down on rogue claims management organizations that bother potential consumers with nuisance calls and persuade them to make frivolous claims.

And Aviva is calling for a total rethink of whiplash claims so that motorists with genuine injuries are presented rehabilitation rather than cash handouts.

“This will aid the genuine injured celebration return to overall health while cutting the expense of motor insurance coverage by at least £32 for everybody,” it mentioned.

Britain"s worst speeders clocked going four times over the limit

As drivers are caught carrying out up to 146 mph on the road, the Institute of Advanced Motorists calls for a adjust in people’s attitudes to driving.

Ever had a speeding ticket? What had been you undertaking – 5, 10 miles over the limit?

How about carrying out 4 occasions the speed limit in a residential zone?

That is what the Institute of Sophisticated Motorists (IAM) found out when they looked at the highest recorded speeds from every single constabulary in England and Wales.

The worst offender was clocked carrying out 128 mph on London Road in East Grinstead, Sussex – a 30 mph zone.

This is what that road looks like:

b6b03 london road east grinstead

Who in their correct mind would drive at 4 instances the speed limit on a road like this?

The quickest recorded speed was 146 mph, where 2 distinct drivers on the M25 had been caught going at more than twice the speed limit.

Sarah Sillars, IAM chief executive officer, mentioned:

“At speeds of 140 mph an individual is travelling at nearly 2-and-a-half miles a minute.

“At that speed it is just not possible to react to something that might happen in front of you.

At that kind of speed, your total stopping distance is elevated to 143 metres – about 85 automobile lengths.

65c94 stopping distances

If you require support visualising what 140mph appears like, this video sums it up quite properly (it is on a motorbike but you get the idea):

On motorways, speeders had been caught driving twice the limit, averaging speeds of about 125 mph.

Even in places exactly where 40 and 50 mph site visitors-calming limits have been introduced, the worst offenders have been driving at an average of 110 mph.

According to the Association of Chief Police Officers (ACPO), the general leeway for issuing a speeding penalty is 10% + 2 mph.

So if you’re driving on a motorway, something previous 79 mph is most likely to get you fined or worse.

But drivers on Intelligent motorways such as the M1, M2, M6 and M25 are using cameras to catch drivers who are only going a couple of miles per hour more than the limit.

In 2013, 3,064 people have been either killed or seriously injured in crashes exactly where speed was a factor.

Rule 125 of the Highway Code states that the speed limit is the absolute maximum and ought to not be deemed a target.

Based on road conditions e.g. ice, even driving at the speed limit can be dangerous.

This still does not cease individuals from breaking the speed limit and posting the benefits on social media:

Pro tip #1: Don’t drive over the speed limit.

Pro tip #2: If you ignored #1, do not take images of you breaking the law and post them on the internet where everybody can see. The police have Twitter also, you know.

Louisiana AG Files Suit Against State Farm Over Auto Repair Practices

Alleging “a culture of unsafe enterprise practices” in its handling of car repairs, Louisiana’s lawyer basic has filed suit against insurance coverage giant State Farm.

Lawyer General Buddy Caldwell’s lawsuit, filed Aug. 19 in the 19th Judicial Court in East Baton Rouge Parish, alleges State Farm has “engaged in a pattern of unfair and fraudulent business practices aimed at controlling the auto repair sector and forcing unsafe repairs on vehicles without having the understanding or consent of Louisiana customers,” according to information released by the AG’s office.

In his announcement, Caldwell mentioned the company’s practice is to make certain that “consumer car repairs are performed with cost-savings as the principal purpose rather than safety and reliability.”

The suit accuses State Farm of violating Louisiana’s Unfair Trade Practices Act and Monopolies Law by “using scare techniques to steer Louisiana buyers to State Farm’s preferred repair shops and forcing shops to execute vehicle repairs cheaply and quickly, rather than in accordance with customer security and vehicle manufacturer performance requirements.”

Caldwell alleges that the company steers claimants to repairs shops that have partnered with State Farm beneath signed agreements that call for them to comply with repair standards set by the insurer, such as how extended the repair should take and what parts may be employed.

“In some situations, we’ve discovered that these components are nothing at all much more than used junk yard parts. In other folks, we’ve discovered them to be foreign knock-off parts of questionable top quality,” Caldwell stated in his written statement.

In an emailed response to a query from Insurance coverage Journal, State Farm Public Affairs Director Phil Supple stated the “description in this lawsuit is not in line with State Farm’s mission to serve the demands of its consumers, and our long, proud history of achievements in advancing vehicle security. We are reviewing the lawsuit and will have much more to share quickly.”

Supple pointed to State Farm’s lengthy-term involvement with the Insurance Institute for Highway Security and the insurer’s part in helping facilitate safety improvements such as car airbags and child passenger security seats, as nicely as fostering research and education aimed at defending young drivers.

In 2012, State Farm wrote a single-third of all private passenger, commercial auto liability and physical harm policies in Louisiana, with premiums totaling far more than $ 1 billion, according to the document filed with the court.

IRC Study: Lawyers Involved in Much more PIP Claims Over Current Years

What you need to know:

  • The share of PIP claimants represented by an attorney was 36% in 2012, up from 31% in 2007.

  • Claimants represented by a lawyer typically “waited longer for payment of claims” compared to those who had no representation.

  • Florida was the no-fault state with the highest rate of attorney involvement. More than half of Florida PIP claimants hired an attorney in 2012.

A new study shows that more drivers are hiring attorneys for claims they file under personal injury protection (PIP) coverage, a coverage type that was first created with the goal of reducing litigation in car insurance claims. The study, published by the Insurance Research Council (IRC), shows that more than 1 out of every 3 PIP claimants hired an attorney in 2012, which is more than double the rate in 1977.

Under PIP coverage, the policyholder’s insurer compensates him or her for medical bills related to a crash, regardless of whether or not that policyholder shared any fault in the crash. This is supposed to help reduce the number of car insurance claims that make it to court.

But the percentage of PIP claimants who hired an attorney recently increased 5 percentage points, going from 31 percent in 2007 to 36 percent in 2012.

According to the IRC, half of claims submitted under bodily injury liability involved attorneys in 2012. That was a only slight increase compared to 2007, when that figure was 49 percent.

Here is a further breakdown of the numbers provided by the IRC:

;

The IRC said that claimants represented by a lawyer typically “waited longer for payment of claims” compared to those who had no representation. Among other findings in the study, according to the IRC, auto injury claimants with lawyers were:

  • “much more likely” than claimants without lawyers to “receive treatment in a pain clinic” and receive an MRI for similar injuries

  • “more likely” to be linked to “apparent claim abuse”

  • on average, awarded lower “net payments” than lawyer-less claimants after payments are adjusted for attorneys fees and other expenses

“The attorney involvement trends shown in this study undercut 2 of the envisioned benefits of no-fault auto injury systems: a less adversarial settlement process and more timely payments,” said Elizabeth Sprinkel, IRC’s senior vice president, in a statement. “The role of attorneys is implicated in many of the factors driving up the cost of auto insurance.”

The IRC’s analysis looked at more than 35,000 auto injury claims that were closed with payment over the last 3 decades.

IRC: More than Half of Florida PIP Claims Involve Attorneys

PIP coverage is required in some states, and it’s been in those so-called “no-fault” states where controversy has brewed in recent years.

“Corrupt lawyers” are often a key ingredient to “medical mills” that criminals set up to produce bogus claims, according to the Insurance Information Institute (III), which added such operations are typically based in no-fault states “where PIP benefits are generous.” The National Insurance Crime Bureau (NICB) has also reported on PIP-based auto insurance systems and their vulnerabilities to crime.

In October 2013, authorities said they uncovered a PIP scheme in Minnesota that rang up more than $ 1 million in kickbacks. Lawmakers responded with a push for legislative reforms of the PIP system. Minnesota drivers are required to have at least $ 40,000 in PIP coverage per auto accident.

According to the IRC’s recent study, the highest rate among no-fault states of PIP claimants hiring attorneys for injury claims was in Florida, where more than half did so in 2012.

In Florida, PIP coverage is required and provides benefits of up to $ 10,000 to a driver suffering an “emergency medical condition” from an auto accident; a $ 2,500 PIP benefit is the maximum allowed in Florida for “nonemergency medical conditions.”

Florida’s 2-tiered system of PIP benefits was just one of the many points of debate between lawmakers in 2012, when they implemented major reforms of the state’s no-fault system. The push for reform was fueled by what some lawmakers said was an alarming increase in fraudulent PIP claims.

Question:

I left South Africa in 2001 and had a motorbike licence and a motor car licence.

I converted my motor car licence abroad but unfortunately at that time did not convert my motor bike licence.

Is there anyway that I can get a letter stating what the old codes where and what they have been converted to.

I used to ride a bike over 125cc.

Answer:

The current licence code for the size of motor vehicle referred hereto is A1, in terms of the old code, the table attached indicates which code is applicable depending on when the licence was issued.
